Attorney Riccio filed a Motion to Suppress breath test evidence based on the police’s failure to comply with the 15-minute observation period prior to the administration of the breathalyzer. The judge agreed with Attorney Riccio finding the police substantially deviated from the requirements of the observation period. As a result, the prosecution cannot introduce any evidence related to the breath test at trial.
